1.The scope of application of these general conditions
These general conditions are applicable to all services (hereinafter referred to as “Service” or “Services” ) offered by AUGENTIC PassCam SA (hereinafter referred to as “AUGENTIC”) on behalf of the DGSN or for its own account to persons (hereinafter referred to as “Applicant “, “Applicants” , “Client” , or “you” , “your”) wishing to file a biometric passport application with the DGSN through AUGENTIC and the possible provision of information by AUGENTIC concerning this biometric passport application. These terms and conditions cover, without limitation and depending on the nature of your biometric passport application (hereinafter referred to as “Passport Application”):
These general conditions constitute the contract governing the provision of the Services by AUGENTIC to the Applicant. You hereby agree and confirm that, prior to submitting your Passport Application, you have read, understood and agreed to be bound by these terms and conditions without limitation or qualification. These general conditions can be consulted at any time on the AUGENTIC website. All changes, modifications, additions or withdrawals of these general conditions will be published on the AUGENTIC website. These modified conditions, as displayed on the AUGENTIC website, will prevail over any previous version, or over any other contradictory document. Unless there is clear evidence to the contrary, the data recorded in the system of information from AUGENTIC constitutes proof of all transactions made by the Applicant with AUGENTIC. These terms and conditions are not applicable to all services provided and/or decisions made regarding your passport application by the DGSN. You acknowledge and agree that AUGENTIC is an intermediary between you and the DGSN as its agent, and that no complaint regarding the decisions made regarding your passport application should be addressed to AUGENTIC.
2. Service orders
In order to order any of the services to be provided by AUGENTIC, the Applicant is required to perform the following actions via the AUGENTIC website:
AUGENTIC will only accept a reservation and an order for Services if the Applicant has previously confirmed, in the manner determined by AUGENTIC, compliance with these general conditions when registering. This confirmation constitutes proof of the contract for the provision of Services to the Applicant. A reservation of Services will not be considered final until AUGENTIC has acknowledged acceptance of the order and received full payment of the price of the Passport Application Fee (the “Passport Application Fee”). . AUGENTIC reserves the right to cancel or refuse any order for Services if there is an existing dispute with the Applicant regarding the payment of previous orders for Services.
3. Service charge
3.1 General conditions of fees to be paid
The charges shown are only valid on the day they are mentioned. For biometric passport applications at a later date, fees may be subject to change. The passport application fee is fixed in XAF but payable in the currency of the country where the Biometric Passport Application Center is located. The exchange rate between these currencies is decided by AUGENTIC and is subject to periodic variations, therefore the amount in local currency you must pay may differ from that indicated. Passport application fees are displayed on the AUGENTIC website or at the DGSN. Except as otherwise provided in these terms and conditions, for example clause 3.2 below, all passport shipping costs, supporting documents and decisions of the issuing authorities are included in the final total price based on the information you provided and the available delivery methods you selected. In order for the request to be processed, all fees must be received in full in cleared funds, depending on the available payment options. 3.2 Passport Application Fee for submitting and processing your biometric passport application (hereinafter referred to as “Service Fee”).
The passport application fee for processing your passport application is agreed between DGSN and AUGENTIC. Any changes to passport application fees will be made in accordance with the agreement with DGSN and will be duly posted on the AUGENTIC website or at DGSN. AUGENTIC issues the Applicant with a receipt after payment of the passport application fee. AUGENTIC has no control over increases or changes to passport application fees collected by AUGENTIC and accepts no liability of any kind in this regard. AUGENTIC has no control and accepts no liability whatsoever it is for all costs exceeding the passport application fees charged by any embassy or consulate of the Republic of Cameroon hosting a Passport Application Center or by the countries of residence of the Applicant. Such fees, if any, are collected by the Applicant’s embassy or consulate or country of residence on their own behalf and AUGENTIC does not accept any requests for reimbursement of such fees and such requests should not be directed to AUGENTIC.
4. Payment terms
The passport application fee can be paid in full either on the day the applicant makes an appointment to submit their passport application or at a later stage before the applicant shows up for the appointment, by the following methods, each depending on when the passport application fee is paid, as specified on the AUGENTIC website:
by Mobile Money;
by credit/debit card and for remote payments (online, by telephone, etc.) by a secure means of payment;
by any other means of payment accepted by AUGENTIC after the entry into force of these general conditions.
AUGENTIC will issue the Applicant a receipt for the transaction after receiving cleared payment of the Fees due. The Applicant is responsible for all fees and commissions they may incur using the payment method available. Payment data is encrypted before transfer using the Secure Sockets Layer (SSL) protocol. AUGENTIC will not be obligated to provide services if the passport application fee has not been paid in full. Payments will not be considered complete until AUGENTIC has duly received the full amount of the Passport Application Fee in fully cleared and available funds.
5. Service delivery
AUGENTIC undertakes to do everything possible to provide the Services to the Applicants according to the appointment date they have chosen. AUGENTIC will process all Passport Applications with reasonable care and skill and in accordance with all procedures prescribed by the DGSN. However, although we will take reasonable care to check your application form for obvious errors, we do not guarantee that all errors on your form will be detected, and we do not undertake to check the information you provide. It is your responsibility to ensure that all information and documents you provide are accurate, truthful and up-to-date. AUGENTIC accepts no liability whatsoever, for any delay in the provision of the Services caused by an event or by a third party, which is beyond the control of AUGENTIC. The times for receipt of decisions from the DGSN concerning your application for a biometric passport are only estimates, based on the information and experience of the DGSN, which are beyond the influence of AUGENTIC and cannot be guaranteed. Applicants are responsible for carefully reading and understanding the requirements set out in the Passport Application forms, completing them truthfully and with correct and accurate information, providing the correct supporting documents, ensuring that they have valid documents as well as to verify the validity of the biometric passport issued (in particular with regard to the date of issue, validity, type of passport, etc. Applicants must provide valid contact details to AUGENTIC so that AUGENTIC can contact if there is a problem with the Applicants’ Biometric Passport application or if additional documentation is required AUGENTIC accepts no liability for any loss resulting from the
6. Cancellation Policy
AUGENTIC will not refund Passport Application Fees or paid to AUGENTIC by Applicants on the grounds that the DGSN refuses to approve the biometric passport application or on the grounds that the Applicant decides to cancel the pending application once the procedure has been initiated . The Passport Application Fee is a non-refundable and non-transferable fee. If however AUGENTIC has committed an act of gross negligence or willful misconduct in relation to a Passport Application submitted, resulting in the rejection of the Passport Application or the loss of the Applicant’s passport duly approved and produced, then AUGENTIC may reimburse the Applicant only Passport Application Fees.
7. Responsibility of AUGENTIC
The DGSN does not give any competence or power to AUGENTIC with regard to the assessment of Passport Applications or the decision-making regarding Passport Applications. Accordingly, AUGENTIC does not accept any responsibility whatsoever for the decisions taken by the DGSN with regard to your Passport Applications and for any delay by the DGSN in the evaluation, granting or rejection of your Passport Application or in the request for additional information regarding your Passport Application. AUGENTIC accepts no responsibility for any loss, delay or non-issuance of a Passport Application or biometric passport resulting from or in connection with (including but not limited to) application forms incomplete, incorrectly or falsely completed application forms, and inaccurate, incomplete or false information or supporting documents. AUGENTIC accepts no liability to any Applicant or other person relying on or benefiting from any Passport Application for any costs or expenses incurred in reliance on or in anticipation of receiving such biometric passport, whether within a particular time frame or not at all, including but not limited to any arrangements made for travel and/or accommodation. AUGENTIC accepts no liability for any loss of profits, business interruption, loss of business or business opportunity, wasteful expenses, or any other loss or damage suffered or incurred by any person, in any manner whatsoever, resulting from delay, misplacement, loss or damage of Passport Applications, biometric passports, other documents, or due to negligence or breach of contract in connection with any Passport Application, passport processing or any advice or information given in connection with any Passport Application. AUGENTIC accepts no liability to any Applicant or other person relying on or benefiting from a Passport Application for any indirect, punitive, incidental, special or consequential damages or damages whatsoever due to any delay, misplacement, loss or damage to Passport Applications, biometric passports and other documents due to negligence or breach of contract, in connection with any Passport Application, the processing of passports or any advice or information given in connection with any Passport Application. AUGENTIC will not be considered in breach of contract and will not be liable in any way for any delay, loss, damage to a biometric passport or any other document or to the Passport Application due to an event beyond the control of AUGENTIC, including, but not limited to, any accident, theft, natural calamity, blackout of electricity and telecommunications, strike, riot, protest not resulting from an intentional fault of AUGENTIC . AUGENTIC shall not be liable for loss, delays, damage to Passport Applications, to the biometric passport or any other document by you or by a third party and outside the control of AUGENTIC. AUGENTIC is not responsible for any delays, losses or damages to Passport Applications, biometric passports or any other documents, caused by, or occurring while in the possession of any third party courier, including the transport of Passport Applications, biometric passports or any other document between AUGENTIC and the DGSN or upon their return to the Applicant. In the exceptional event that the Passport Application or any other document submitted by the Applicant is lost or seriously damaged, resulting in the rejection of the passport or rendering it unusable due to gross negligence on the part of AUGENTIC, AUGENTIC will not reimburse the Applicant as the Passport Application Fee. The Claimant will need to present the original payment receipt in order to request a refund. AUGENTIC will not pay Applicant for any other costs incurred by Applicant in obtaining the replacement, including, without limitation, travel expenses, accommodation expenses, lost time.
8. Data protection
The entity responsible for processing the data collected for your passport application is AUGENTIC. AUGENTIC collects personal data from Applicants as part of ordinary biometric passport applications, including information provided through printed and online application forms, and other documents. This information may include names, addresses, contact details, place of birth, employment details, travel details, biometric data such as fingerprints and biometric photos. AUGENTIC only requests, collects and processes the personal data strictly necessary for the provision of the Services subject to these general conditions, including, but not limited to, for the purposes of processing your biometric passport application and for the purposes of performing any additional Services, which may require you to submit additional information to our Services. You hereby consent to the collection, storage, processing and submission of your personal information by AUGENTIC as well as the transfer of your personal information to DGSN during the biometric passport application process. You hereby consent and acknowledge that AUGENTIC has the right to transmit your personal data to partners responsible for the strict execution of all or part of the Services subject to these conditions. For any service not covered by these terms and conditions that may be offered to you by a third party, AUGENTIC will only share your data with your consent. All third-party partners are committed to providing a sufficient level of protection with respect to your personal data in order to ensure the security of your personal data. Your personal data is also kept and processed separately by the DGSN in accordance with its data protection policies and procedures. In accordance with the applicable regulations, Applicants may have various rights regarding the processing of their personal data, such as the right to be informed, to access, modify, rectify or erase their personal data, or to object and restrict the processing of their personal data as well as data portability.’ AUGENTIC and applicable to the Biometric Passport Application Center where Applicants place their orders.
9. Intellectual property
The content of the AUGENTIC website is the intellectual property of the AUGENTIC group and is protected by applicable intellectual property and antitrust laws. The reproduction or placement of all or part of this information on other websites unrelated to the AUGENTIC site is strictly prohibited and constitutes an act of counterfeiting. Furthermore, AUGENTIC retains all intellectual property rights to the photographs, presentations, studies, drawings, models, prototypes, etc. made (including at the request of the Applicant) in the context of the provision of the Services. The Applicant therefore undertakes not to reproduce or use these studies, drawings, models, prototypes, etc. without the express prior written authorization of AUGENTIC,
10. Applicable right
These general conditions and the transactions envisaged in this document are governed by the laws applicable in the Republic of Cameroon.
11. Disputes
All disputes arising from the provision of services or related transactions entered into under these terms and conditions and concerning their validity, interpretation, execution, termination, consequences and implications, which cannot be resolved amicably between AUGENTIC and the Applicants, will be subject to the competent courts under the laws applicable in the country of the Biometric Passport Application Center where the Applicant has provided their biometric data.
12. Changes to these Terms and Conditions
AUGENTIC may, at its sole discretion, change, modify, cancel or withdraw all or part of these terms and conditions at any time and without notice, in accordance with clause 1 of these terms and conditions. Any such changes will be posted on the AUGENTIC website.
13. General
The titles of the clauses are given for information only and are not used to interpret these terms and conditions. AUGENTIC makes no warranties or representations that are not contained in these terms and conditions. Any extension of time or indulgence that AUGENTIC may grant to an Applicant does not constitute a waiver of any of the rights of AUGENTIC, which may exercise all rights against the Applicant which may have arisen in the past or which may arise in the future. All provisions of these Terms and Conditions are severable from one another, despite how they have been grouped together or grammatically linked.
